Death Penalty Qualified or Certified: What does this mean? Very few attorneys in the State of Florida are Death Penalty qualified or certified. Attorneys who achieve this designation are the only lawyers who can be assigned by a Circuit Court Judge to represent a person who is charged with First Degree Murder and facing the possibility of having the Death Penalty imposed upon them. The Florida Supreme Court has promulgated rules that require attorneys in these cases to meet very demanding and sepecific criteria as far as their criminal law practice, continuing legal education, and actual handling of Death Penalty cases. Because these cases are the most highly complex and serious of all criminal law cases, they are given the greatest scrutiny by the Florida Supreme Court.
Even though you or your loved one may not be facing the death penalty, having such an attorney for representation in a criminal law matter is reassuring, for if the attorney is qualified for the most serious and most complex of cases, they should be able to provide the highest level of reperesentation on all other criminal law situations.
